| Terms and Conditions/Privacy Policy Please read this Agreement carefully as it governs your use of, and purchase of products from, the buckfast.org.uk web site (“Site”). By continuing to use our Site you are agreeing to the terms set out below. 1. Provision of Web Site Service The Site is owned and operated by Dart Abbey Enterprises Limited (company number 01435171), ("Buckfast") whose registered office is at Buckfast Abbey, Buckfast, Devon TO11 0EE. 2. Limited Rights to Use Content 2.1 All material including any intellectual property in it displayed on the Site ("Content") belongs to Buckfast or its suppliers. Subject to section 2.2, we give you the right, for your own personal or non-commercial purposes only to: retrieve and display the Content on your PC screen print individual pages on paper You do not have the right to store any Content on any server or other storage device connected to an external network or make any other use of the Content. 2.2 Most of the Content is owned by Buckfast but certain Content is used with the permission of third parties ("Third Party Content") and may be subject to additional restrictions. These restrictions and/or intellectual property rights will be highlighted through hyperlinks on the appropriate pages. You must comply with such restrictions and/or copyrights. 2.3 You may not, without prior written permission from Buckfast given within the previous 6 months: redistribute any of the Content or supply it to other people; remove the copyright or trade mark notices from any copies of Content made under this Agreement; create a database in any form (including electronic or structured manual form) by downloading, copying and storing all or any of the Content; except as expressly set in this Agreement, modify, reproduce or in any way use any of the Content. 3. Participation 3.1 Buckfast allows you to submit material to certain areas of the Site. Buckfast reserves the right to delete, move and edit any material submitted. You are solely responsible for the material you submit to the Site and by submitting any material you agree that you will not submit any material that: advertises or promotes any goods or services deemed to be in competition with Buckfast; reveals any confidential or sensitive information; contains or links to any unlawful, threatening, abusive, libelous, indecent or otherwise illegal material; contains any material which you do not have permission to use (including material which may be protected by copyright, trade marks, database rights or any other form of intellectual property right); contains viruses or any other components with harmful or contaminating properties which may affect the Site or any equipment connected to it; or disguises your identity or impersonates any person or entity, including, but not limited to, a Buckfast employee, or falsely claims or otherwise misrepresents your affiliation with a person or entity. 3.2 Buckfast welcomes your comments, suggestions, ideas and other material you provide or send directly to us. By submitting material to the Site, you grant Buckfast a perpetual royalty free, non-exclusive licence to reproduce, modify, translate, make available, distribute and sub-licence any material you submit in whole or in part or in any form. You agree that you waive any moral rights you have in the material. 3.3 The Site contains material and content submitted by persons (“Users”) over whom Buckfast has no control. Buckfast cannot guarantee the accuracy, integrity or quality of any such material. Some Users may breach these terms and post material that is misleading, untrue or offensive you must bear all risks associated with and resulting from your viewing of such material. 3.4 Copyright of any software that is made available for download for the participation in the Site ("Software") belongs to Buckfast, its suppliers or Third Parties. Your use of the Software is governed by the terms of any licence agreement that may accompany or be included with the Software. Certain pages on the Site may also be subject to additional terms of use that will be made available clearly by hyperlink and you must comply with all such terms. 3.5 You acknowledge that Buckfast has the right to refuse, delete or move any material that is available on the Site. 4. Purchases 4.1 The prices for goods displayed for sale on the Site are as set out on the Site and are inclusive of VAT. Where additional charges are made for delivery, they are clearly displayed. Prices and delivery charges displayed are valid and effective only in the United Kingdom. Buckfast cannot accept your order until you have paid for it in full (including applicable delivery charges). Upon payment, we will confirm acceptance of your order by e-mail which will be sent to the e-mail address you provide on your order details. Whether or not you receive an e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion. Pursuant to the Licensing Act 2003 it is an offence to purchase or attempt to purchase alcoholic beverages if you are under the age of 18 and it is an offence to purchase or attempt to purchase liqueur chocolates if you are under the age of 16. 4.2 Credit and debit card payments All card payments are processed by [ ]. You pay them a [ ] % fee, which is included in the total. The balance is paid to Buckfast. The total amount you pay is the same, regardless of the payment method. 4.3 Your right to cancel your order You may cancel your order at any stage before the expiry of the period of 7 working days beginning with the day after the day on which you receive the goods or at any stage before the goods are delivered. If you wish to cancel your order, you can either [insert cancellation procedures]. On cancellation of an order after you have received the goods, [insert returns policy including responsibility for payment etc]. 4.4 Returns and refunds If you are not satisfied with the order you have received you may return it to us within 28 days of delivery. We will exchange or refund any unused items returned to us, as sold in their original condition, with the sales invoice received with your order. If your goods are incorrect, faulty or damaged on delivery we will exchange the product or issue a full refund to you including delivery charges. If you are not satisfied with the goods or for any other reason we will exchange or refund any unused items as sold, in their original saleable packaging, to you including delivery charges. The collection of the goods will be arranged through our nominated delivery carrier and the cost of return will be at your expense. Perishable goods, CD’s, DVD’s, tapes or other recording media where the seal is broken cannot be exchanged or refunded (unless they are faulty). We reserve the right to refuse an exchange or refund with or without a receipt. Refunds will be paid within 30 days of receipt of the returned order. 5. Limited Warranties Buckfast will use its reasonable skill and care in making sure that the Site is available to you on a continual basis. However, because of the number of sources from which Buckfast obtains the Content and because of the nature of the Internet, Buckfast does not give you any other warranties. In particular, you should not take the accuracy or availability of the information for granted and Buckfast makes no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties. 6. Limitation of Liability In respect of the Content that is available on the Site, Buckfast will use its reasonable endeavours to resolve faults. You agree that Buckfast will not be liable for any losses (other than damages for death or personal injury resulting from Buckfast's negligence) you may incur as a result of your use or non-use of that Content. 7. Privacy Policy 7.1 Buckfast is committed to protecting the privacy of those using our Site. The information that you provide about yourself to Buckfast will only be used by Buckfast in accordance with its Privacy Policy as set out below. By using our web site, you consent to the collection and use of personal information by Buckfast. If we decide to change our privacy policy, we will post changes on this page so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it. 7.2 Personal Information Any personal information provided to or to be collected by us on this Site is controlled by Buckfast. We will only collect information about individuals where it is specifically and knowingly provided. When you order, we collect personal information such as your name, e-mail address, delivery address, telephone number, credit or debit card number and the card’s expiry date to process and fulfil your order(s). When you place an order we will carry out security checks to protect against fraudulent transactions. We may also use personal information to contact you with information about our goods and services that we think may be of interest to you.
